When the COVID-19 surge hit New York City hospitals, the Division of Medical Ethics at Weill Cornell Medical College, and our affiliated ethics consultation services, faced waves of ethical issues sweeping forward with intensity and urgency. In this article, we describe our experience over an eight-week period (16 March through 10 May 2020), and describe three types of services: clinical ethics consultation (CEC); service practice communications/interventions (SPCI); and organizational ethics advisement (OEA). We tell this narrative through the prism of time, (...) describing the evolution of ethical issues and trends as the pandemic unfolded. We delineate three phases: anticipation and preparation, crisis management, and reflection and adjustment. The first phase focused predominantly on ways to address impending resource shortages and to plan for remote ethics consultation, and CECs focused on code status discussions with surrogates. The second phase was characterized by the dramatic convergence of a rapid increase in the number of critically ill patients, a growing scarcity of resources, and the reassignment/ redeployment of staff outside their specialty areas. The third phase was characterized by the recognition that while the worst of the crisis was waning, its medium- and long-term consequences continued to pose immense challenges. We note that there were times during the crisis that serving in the role of clinical ethics consultant created a sense of dis-ease as novel as the coronavirus itself. In retrospect we learned that our activities far exceeded the familiar terrain of clinical ethics consultation and extended into other spheres of organizational life in novel ways that were unanticipated before this pandemic. To that end, we defined and categorized a middle level of ethics consultation, which we have termed service practice communication intervention (SPCI). This is an underappreciated dimension of the work that ethics consult services are capable of in times of crisis. We believe that the pandemic has revealed the many enduring ways that ethics consultation services can more robustly contribute to the ethical life of their institutions moving forward. (shrink)

Designer Biology: The Ethics of Intensively Engineering Biological and Ecological Systems consists of thirteen chapters that address the ethical issues raised by technological intervention and design across a broad range of biological and ecological systems. Among the technologies addressed are geoengineering, human enhancement, sex selection, genetic modification, and synthetic biology.

Varro's De lingua Latina is a treasure trove of information. Of the originally twenty-five books, six have come down to us more or less complete. Among these, Books 5–7 give us many hundreds of etymologies, and Books 8–10 discuss the question whether Latin morphology is regular or not. What Varro rarely comments on is sociolinguistic variation. The sociolinguistic comments in Varro's work can almost be counted on one hand. For instance, in 5.162 Varro remarks that cenaculum, from cena ‘dinner’, means (...) ‘attic’ in Roman Latin, but that the original meaning was, as one might expect, ‘dining-room’, a meaning preserved in the non-Roman dialects of Latium, Falerii and Corduba in Spain; the meaning also lives on in religious uses in Lanuvium. In 7.96, Varro tells us that some words are pronounced with -ae- by some, but with -ē- by others. We know that non-Roman varieties of Latin monophthongized -ae- earlier than the Roman dialect did. Varro mentions pairs like scaena / scēna ‘stage’, a loan from Greek σκηνή, which shows that -ae- is hypercorrect here. Interestingly, only in one such pair is the variant with -ē- ascribed to country people, in the name Maesius / Mēsius, and this is indeed the only pair where the diphthong -ae- is original rather than the result of hypercorrection. Living donation provides important access to organ transplantation, which is the optimal therapy for patients with end-stage liver or kidney failure. Paired exchanges have facilitated thousands of kidney transplants and enable transplantation when the donor and recipient are incompatible. However, frequently willing and otherwise healthy donors have contraindications to the donation of the organ that their recipient needs. Trans-organ paired exchanges would enable a donor associated with a kidney recipient to donate a lobe of liver and a donor associated with (...) a liver recipient to donate a kidney. This article explores some of the ethical concerns that trans-organ exchange might encounter including unbalanced donor risks, the validity of informed consent, and effects on deceased organ donation. Creating effective teamwork between humans and robots involves not only addressing their performance as a team but also sustaining the quality and sense of unity among teammates, also known as cohesion. This paper explores the research problem of: how can we endow robotic teammates with social capabilities to improve the cohesive alliance with humans? By defining the concept of a human–robot cohesive alliance in the light of the multidimensional construct of cohesion from the social sciences, we propose to address this (...) problem through the idea of multifaceted human–robot cohesion. We present our preliminary effort from previous works to examine each of the five dimensions of cohesion: social, collective, emotional, structural, and task. We finish the paper with a discussion on how human–robot cohesion contributes to the key questions and ongoing challenges of creating robotic teammates. Overall, cohesion in human–robot teams might be a key factor to propel team performance and it should be considered in the design, development, and evaluation of robotic teammates. (shrink)

We use the model theoretic notion of coheir to give short proofs of old and new theorems in Ramsey Theory. As an illustration we start from Ramsey's theorem itself. Then we prove Hindman's theorem and the Hales-Jewett theorem. Finally, we prove the two Ramsey theoretic principles that have among their consequences partition theorems due to Carlson and to Gowers.

In this work I argue that Descartes was not a trialist by showing that the main tenets of trialist interpretations of Descartes's theory of substance are either not supported by the text or are not sufficient for establishing the trialist interpretation.

Many have argued that allowing and encouraging public avenues for dissent and critical evaluation of scientific research is a necessary condition for promoting the objectivity of scientific communities and advancing scientific knowledge . The history of science reveals many cases where an existing scientific consensus was later shown to be wrong . Dissent plays a crucial role in uncovering potential problems and limitations of consensus views. Thus, many have argued that scientific communities ought to increase opportunities for dissenting views to (...) be heard and taken seriously. Abstract BACKGROUND: Anonymity remains the more common practice in gamete donations, but legislation prohibiting anonymity with a goal of protecting donor-conceived children's right to know their genetic origins is becoming more common. However, given the dearth of research investigating the function of anonymity for donors and recipients, it is unclear whether these policies will accomplish their goals. The aim of this study was to explore experiences with anonymity among oocyte donors and recipients who participated in an anonymous donor oocyte program (...) and to understand the ways in which anonymity functions for them. -/- METHODS: Semistructured interviews were conducted with 50 women: 28 oocyte donors and 22 recipients who were recruited from an academic center for reproductive medicine in the United States. -/- RESULTS: Donors and recipients view anonymity both as a mechanism to protect the interests of all parties (recipients, donors, and donor-conceived children) and as a point of conflict. Specifically, three key areas were identified where both donors and recipients saw anonymity as having an important role: relieving anxieties about family structures and obligations; protecting their interests and those of donor-conceived children (while acknowledging where interests conflict); and managing the future. -/- CONCLUSION: As gamete donation increasingly moves away from the practice of anonymity, examining why anonymity matters to stakeholders will be helpful in devising strategies to successfully implement identity-release options. In this article, I report on a Bulgarian female migrant caregiver's “life-story,” especially focusing on her relationship with an old Italian woman, on the care practices performed in her favor in Italy, and on her daughter and parents still living in Bulgaria. I chose to do it by means of an anthropological approach based on experience as field of mediation between personal dimensions and historical and social processes and therefore centered on the body conceived as historical product, the influence of (...) political and social forces on shaping human lives, and finally interest in the specific link between bodies and work. From this analysis, based on language and narratives, I think useful cultural aspects may emerge about “gender” and care practices, regarding the two women linked by an assistance relationship, and the activities/strategies used by the Bulgarian caregiver to fulfill her family obligations. This paper includes a concise survey of the work done in compliance with de Finetti's reconstruction of the Bayes-Laplace paradigm. Section 1 explains that paradigm and Section 2 deals with de Finetti's criticism. Section 3 quotes some recent results connected with de Finetti's program and Section 4 provides an illustrative example.

A growing number of jurisdictions hold that gamete donors must be identifiable to the children born with their eggs or sperm, on grounds that being able to know about one's genetic origins is a fundamental moral right. But the argument for that belief has not yet been adequately made.

Some important ideas in Kelsen's Pure Theory of Law can be traced back to Kantian tradition, which has been very influential in Kelsen's thought, particularly in his early period. Among them we find the distinction between two radically different worlds (the world of facts and the world of norms), the normativity of legal science and the idea of validity as a binding force, based on the famous doctrine of the basic norm. These tenets and, especially, the use of a normative (...) concept of validity prove to be incompatible with Kelsen's positivistic programme of a value‐free legal science. The science of law cannot state that legal norms are obligatory or binding without trespassing the limits of Kelsen's ideal of a legal science; on the other hand, it is possible to define the concept of a legal system without resorting to the basic norm. So, if Kelsen is to be regarded as a consequent positivist, the Kantian ingredients of his theory must be rejected and the descriptive concept of validity as membership must be substituted for the normative notion of validity as a binding force. It now seems technically feasible to culture human embryos beyond the “fourteen‐day limit,” which has the potential to increase scientific understanding of human development and perhaps improve infertility treatments. The fourteen‐day limit was adopted as a compromise but subsequently has been considered an ethical line. Does it remain relevant in light of technological advances permitting embryo maturation beyond it? Should it be changed and, if so, how and why? What justifications would be necessary to expand the limit, particularly given that (...) doing so would violate some people's moral commitments regarding human embryos? Robust stakeholder engagement preceded adoption of the fourteen‐day limit and should arguably be part of efforts to reassess it. Such engagement could also consider the need for enhanced oversight of human embryo research. In the meantime, developing and implementing reliable oversight systems should help foster high‐quality research and public confidence in it. (shrink)

Liar-like paradoxes are typically arguments that, by using very intuitive resources of natural language, end up in contradiction. Consistent solutions to those paradoxes usually have difficulties either because they restrict the expressive power of the language, or else because they fall prey to extended versions of the paradox. Dialetheists, like Graham Priest, propose that we should take the Liar at face value and accept the contradictory conclusion as true. A logical treatment of such contradictions is also put forward, with the (...) Logic of Paradox, which should account for the manifestations of the Liar. In this paper we shall argue that such a formal approach, as advanced by Priest, is unsatisfactory. In order to make contradictions acceptable, Priest has to distinguish between two kinds of contradictions, internal and external, corresponding, respectively, to the conclusions of the simple and of the extended Liar. Given that, we argue that while the natural interpretation of LP was intended to account for true and false sentences, dealing with internal contradictions, it lacks the resources to tame external contradictions. Also, the negation sign of LP is unable to represent internal contradictions adequately, precisely because of its allowance of sentences that may be true and false. As a result, the formal account suffers from severe limitations, which make it unable to represent the contradiction obtained in the conclusion of each of the paradoxes. (shrink)

JL his paper calls into question a conventional way of reading the passage concerning knowledge and belief at the end of book 5 of Plato's Republic. On the conventional reading, Plato is committed to arguing on grounds that his philosophical opponents would accept, but this view fails to appreciate the rhetorical context in which the passage is situated. Indeed, it is not usually recognized or considered important that the passage has a rhetorical context at all. Philoso phers typically reduce the (...) questions asked by Socrates and the an swers given by Glaucon in the presence of a large audience, to one continuous argument of Plato's. Unfortunately, this way of reading book 5 ignores two points that are crucial to its interpretation: (1) the Socrates-Glaucon dialectic is directed to hostile (not merely intel lectually opposed) interlocutors, and (2) the relation between Socra tes and his audience (Glaucon excepted) is one of antagonism.1 I shall argue that scholars have for a long time been trying to find more philosophical fruit in the passage than it has to bear, largely because they have misconstrued its role in the argument of the Re public. The U.S. Food and Drug Administration (FDA) announced recently that food products derived from some animal clones and their offspring are safe for human consumption. In response to criticism that it had failed to engage with ethical, social, and economic concerns raised by livestock cloning, the FDA argued that addressing normative issues prior to issuing a final ruling on animal cloning is not part of its mission. In this article, the authors reject the FDA's claim that its mission to protect (...) and advance public health can be accomplished without considering ethical issues or without making value judgments. The authors offer two arguments in support of their position. First, the agency's mission statement presupposes significant normative commitments and judgments. Second, the FDA's risk assessment of food products from cloned animals and their offspring is itself clearly shaped by a variety of normative commitments. (shrink)

In 1911 the Wilson cloud chamber opened new possibilities for physics pedagogy. The instrument, which visualized particles’ tracks as trails of condensed vapour, was adopted by physicists to pursue frontier research on the Compton effect, the positron and the transmutation of atomic nuclei. But as the present paper will show, Wilson's instrument did not just open up new research opportunities, but the possibility of developing a different kind of teaching. Equipped with a powerful visualization tool, some physicists–teachers employed Wilson's instrument (...) to introduce their students to a wide range of phenomena and concepts, ranging from the behaviour of clouds to Einstein's photon, the wave–particle duality and the understanding of the nucleus. This paper uses the notes, books and prototypes of these pioneering physicists–teachers to compose a pedagogical history of the Wilson cloud chamber, documenting an episode of immense ingenuity, creativity and scientific imagination. ABSTRACT The purpose of this paper is to examine critically Julian Savulescu's claim that people should select, of the possible children they could have, the one who is expected to have the best life, or at least as good a life as the others, based on the relevant, available genetic information, including information about non‐disease genes. I argue here that in defending this moral obligation, Savulescu has neglected several important issues such as access to selection technologies, disproportionate burdens on women, (...) difficulties in determining what is best, problems with aggregate effects of individual choices, and questions about social justice. BackgroundGenetic/genomic testing (GGT) are useful tools for improving health and preventing diseases. Still, since GGT deals with sensitive personal information that could significantly impact a patient’s life or that of their family, it becomes imperative to consider Ethical, Legal and Social Implications (ELSI). Thus, ELSI studies aim to identify and address concerns raised by genomic research that could affect individuals, their family, and society. However, there are quantitative and qualitative discrepancies in the literature to describe the elements that provide content (...) to the ELSI studies and such problems may result in patient misinformation and harmful choices.MethodsWe analyzed the major international documents published by international organizations to specify the parameters that define ELSI and the recognized criteria for GGT, which may prove useful for researchers, health professionals and policymakers. First, we defined the parameters of the ethical, legal and social fields in GGT to avoid ambiguities when using the acronym ELSI. Then, we selected nine documents from 44 relevant publications by international organizations related to genomic medicine.ResultsWe identified 29 ELSI sub-criteria concerning to GGT, which were organized and grouped within 10 minimum criteria: two from the ethical field, four from the legal field and four from the social field. An additional analysis of the number of appearances of these 29 sub-criteria in the analyzed documents allowed us to order them and to determine 7 priority criteria for starting to evaluate and propose national regulations for GGT.ConclusionsWe propose that the ELSI criteria identified herein could serve as a starting point to formulate national regulation on personalized genomic medicine, ensuring consistency with international bioethical requirements. The article, as part of a broader reflection on the criticism of the right to development and its impact on the modes of legal and political subjectivation of children and adolescents, questions the child's condition as a subject without speech, or a speech conditioned to criteria of maturation, dictated by the adult referential, in a field, moreover, limited to what is said to be pertinent to their manifestation. Guided by the thought of exteriority, we return to the Foucauldian debate on (...) the relation between truth and justice, in light of the monstrous unspeakability of legal and judicial practices and the ubuesco of state power. We will analyze, through the contributions of classic cynicism, supported by Foucault, and Sloterdijk, Nieheus-Pröbsting, the resistant practices - beyond language – available to children and adolescents, and rethink these power struggles in the context of human rights and the possibility of justice, through the thought of Derrida, Rancière, Butler and Foucault. Our text will develop along the following axes of analysis: 1. Contextualizing the Foucaultian debate on truth and justice and the place of the “sayable”; 2. Considering the sayability at the heart of law, childhood and monstrosity; 3. Framing the struggle between ubuesco power and cynic resistance, and 4. Speculating on our notions of “child” and the possibility of justice. (shrink)

One of the key insights of Simone de Beauvoir’s The Second Sex is the idea that gender-based subordination is not just something done to women, but also something women do to themselves. This raises a question about ethical responsibility: if women are complicit, or actively implicated in their own oppression, are they at fault? Recent Beauvoir scholarship remains divided on this point. Here, I argue that Beauvoir did, in fact, ethically criticize many women for their complicity, as a sign of (...) what she called “bad faith”. I challenge recent accounts by Nancy Bauer and Manon Garcia, who both read Beauvoir as exonerating complicit women. According to this reading, women emerge as human “freedoms” within a social world where a “destiny” of inferiority is already prepared for them. Their self-subordination is then an inevitable product of acting in a patriarchal world. I argue, however, that this interpretation generates a crucial tension, leading Bauer and Garcia to call on women to stop being complicit, while also claiming they cannot avoid complicity. I propose instead a different interpretation, on which feminine complicity is often fueled by criticizable ethical attitudes that are far from inevitable. By revisiting Beauvoir’s notion of “bad faith”, I show that this account is compatible with recognizing the limitations imposed on women’s agency and I show that this feminist ethical criticism is itself an important part of a collective project of social transformation. De hecho, las ideas de espontaneidad y sistema, centrales en la teoría kantiana de la mente, encontraron su analogía empírica en la idea de epigénesis de la naturaleza, una noción que Kant utiliza para dar respuesta a la cuestión de la genesis y validez de las represenraciones puras. Para el autor, la idea de epigénesis compendia la revolución (...) copernicana de Kant en la medida en que aquélla ilustra el papel productivo del entendimiento humano en la constitución de la experiencia.This paper explores the meaning of the biological terms “epigenesis” and “preformation” in Kant’s intellectual development, as well as its epistemological implications. In fact, spontaneity and system, two central ideas in Kant’s theory of mind, found their empirical analogy in the idea of epigenesis in nature, a notion that Kant uses to give answer to the question of the genesis and validity of the pure representations. For the author, epigenesis summarizes Kant’s Copernican Revolution in the measure in which that idea illustrates tbe productive role of the human understanding in the constitution of experience. In the long history of the interpretations of Hume's theses on the self and personal identity, it is by now widely accepted that the conclusions reached in the first book of the Treatise must be considered in light of what the philosopher adds on these themes in the second and third books. Furthermore, there is no longer much support for the reading, which saw a contradiction here, given that while in the Book 1 he denies the reality of the self (...) or of personal identity, he then accepts that reality when he turns to his discussion of the passions. In presenting a more comprehensive reading of the theses of Hume on the self in the Treatise as a whole, it is essential not to lose sight of what Hume himself declared in Book 1, that "we must distinguish betwixt personal identity, as it regards our thought or imagination, and as it regards our passions or the concern we take in ourselves". But having recognized the necessity of integrating the theses on the self of Book 1 with those advanced in the latter two books, there are still divergent opinions on what meaning should be assigned to this integration. The relationship between what Hume writes on the self in Books 2 and 3 and the discussion of that topic in Book 1 has been seen, variously, as a mere continuation, as a new development in a continuous interpretation, or, rather, as a completely new posing of the question, with its own new solution. The greatest rhetorical display (έπιδείξις) of Plato's Protagoras is apparently not Protagoras's famous myth cum démonstration1 about the teachability of excellence (αρετή),2 but rather the dia logue as a whole. The Protagoras exposes key différences between the methods and presuppositions of Socrates and those of the Sophists - thus defending Socrates against the charge of being a Sophist himself - and in so doing clarifies the conditions and princi ples of ethical argumentation.3 The display of the Protagoras oc curs on (...) two levels. In the drama, Socrates puts the Sophists on exhibit for the benefit of Hippocrates, an Athenian boy who as pires to a sophistic éducation. In reading the dialogue, however, we become spectators to Plato's display. The pervading irony is that Piato uses the Protagoras to critieize the techniques of display and debate - and to contrast them with dialogue. But the Socratic/ Platonic display in the Protagoras is literally a showing forth, a manifestation of what a Sophist is and does, whereas a sophistical display is a showing off, that is not intrinsically related to his beliefs and aims. In order to see thèse thèmes at work in the Protagoras , however, it must first be examined from a rhetorical point of view. (shrink)

Current developments in biomedicine are presenting us with difficult ethical decisions and raising complex policy questions about how to regulate these new developments. Particularly vexing for governments have been issues related to human embryo experimentation. Because some of the most promising biomedical developments, such as stem cell research and nuclear somatic transfer, involve such experimentation, several international bodies have drafted documents aimed to provide guidance to governments when developing biomedical science policy. Here I focus on two such documents: the Council (...) of Europe's Convention for the Protection of Human Rights and Dignity of the Human Being and the Additional Protocol to the Convention for the Protection of Human Rights and Dignity of the Human Being.I argue that by using human dignity as a criterion to determine the permissibility of particular human embryo research practices, these documents cannot aid in identifying research that would be contrary to human dignity. Thus, they fail to guide public policy on embryo experimentation. Their use of human dignity as a criterion makes their task of offering guidance unfeasible because the concept as used in these documents is too vague and is applied in contradictory ways. I discuss the main goals of these documents and their claims in relation to human embryo research. I then discuss how they have influenced public policy in several countries. Finally, I show that although these Council of Europe treaties attempt to serve as public policy guides in the area of embryo research, they fail to do so. (shrink)

It might come as a surprise to many that Spain, a country with a strong Catholic tradition that officially banned contraceptive technologies until 1978, has some of the most liberal regulations in assisted reproduction in the world. Law No. 35/1988 was one of the first and most detailed acts of legislation undertaken on the subject of assisted-conception procedures. Indeed, not only did the law permit research on nonviable embryos, it made assisted reproductive technologies available to any woman, whether married or (...) not, through the national healthcare system. In recent years, online “involuntary celibate” or “incel” communities have been linked to various deadly attacks targeting women. Why do these men react to romantic rejection with not just disappointment, but murderous rage? Feminists have claimed this is because incels desire women as objects or, alternatively, because they feel entitled to women’s attention. I argue that both of these explanatory models are insufficient. They fail to account for incels’ distinctive ambivalence toward women—for their oscillation between obsessive desire and violent hatred. (...) I propose instead that what incels want is a Beauvoirian “Other.” For Beauvoir, when men conceive of women as Others, they represent them as simultaneously human subjects and embodiments of the natural world. Women function then as sui generis entities through which men can experience themselves as praiseworthy heroes, regardless of the quality of their actions. I go on to give an illustrative analysis of Elliot Rodger’s autobiographical manifesto, “My Twisted World.” I show how this Beauvoirian model sheds light on Rodger’s racist and classist attitudes and gives us a better understanding of his ambivalence toward women. It therefore constitutes a powerful and overlooked theoretical alternative to accounts centered on objectification and entitlement. (shrink)

This article is part of the research project ‘Representação midiática da violação de direitos e da violência contra pessoas em situação de rua no jornalismo on-line’, associated with Red Latinoamericana de Análisis Crítico del Discurso de la Extrema Pobreza, and focuses upon the ways in which electronic news media represent homeless people in Brazil. The focus is a pair of texts, related through internal hyperlinks, about the controversy concerning the installation of a social center in a middle-class neighborhood in central (...) Sao Paulo. The texts are analyzed on the theoretical basis of critical discourse analysis and considering the following analytical categories: metaphor, representation of social actors and intertextuality. Analyses show a scenario of ‘invasion by unwelcome people’, who are not perceived as rights holders, but as a threat to the rights of others. (shrink)

Eugenio Bulygin is a distinguished representative of legal science and legal philosophy as they are known on the European continent - no accident, given the role of the civil law tradition in his home country, Argentina. Over the past half-century, Bulygin has engaged virtually all major legal philosophers in the English-speaking countries, including H.L.A. Hart, Ronald Dworkin, and Joseph Raz. Bulygin's essays, several written together with his eminent colleague and close friend Carlos E. Alchourrón, reflect the genre familiar from (...) Alf Ross's On Law and Justice, Hans Kelsen's Pure Theory of Law, and Georg Henrik von Wright's Norm and Action. Bulygin's wide-ranging interests include most of the topics found under the rubric of analytical jurisprudence - interpretation and judicial reasoning, validity and efficacy of law, legal positivism and the problem of normativity, completeness and consistency of the legal system, the nature of legal norms, and the role of deontic logic in the law. The reader will take delight in the often agreeably unorthodox character of Bulygin's views and in his hard-hitting arguments in defence of them. He challenges the received opinion on gaps in the law, on legal efficacy, on permissory norms, and on the criteria for legal validity. Bulygin's essays have been wellnigh inaccessible in the past, appearing in specialized journals, often in Spanish or German. Resumo: Este artigo possui o propósito de colocar à prova a interpretação heideggeriana acerca das noções nietzschianas de vontade de potência e eterno retorno do mesmo. Para levar a cabo o referido objetivo, de início, apresentaremos o argumento desenvolvido por Heidegger nas suas preleções e textos sobre Nietzsche, editadas e publicadas em dois volumes, no ano de 1961. Num segundo momento, examinaremos, em Nietzsche: sua filosofia dos antagonismos e os antagonismos de sua filosofia, a resposta que Müller-Lauter ofereceu à crítica (...) de Heidegger. Por ocasião deste exame, tentaremos salientar que haveria certa insuficiência na réplica deste comentador. Por fim, iremos recorrer aos textos do próprio Nietzsche para tentar promover uma confrontação com a interpretação do Filósofo da Floresta Negra.: This article has the purpose to challenge the Heideggerian interpretation of Nietzsche’s notions of will to power and eternal recurrence. To carry out this objective, we will first present the argument developed by Heidegger in his lectures and texts on Nietzsche, edited and published in two volumes, in 1961. In a second moment, we will examine, in Nietzsche: his philosophy of antagonisms and the antagonisms of his philosophy, the answer that Müller-Lauter offered to Heidegger’s criticism. On the occasion of this examination, we will try to point out that there would be a certain insufficiency in this commenter’s reply. Finally, we will resort to Nietzsche’s own texts to try to promote a confrontation with the Black Forest Philosopher’s interpretation. (shrink)

We examine the "Theaetetus" in the light of its juxtaposition of philosophical, mathematical and sophistical approaches to knowledge, which we show to be a prominent feature of the drama. We suggest that clarifying the nature of philosophy supersedes the question of knowledge as the main ambition of the "Theaetetus". Socrates shows Theaetetus that philosophy is not a demonstrative science, like geometry, but it is also not mere word-play, like sophistry. The nature of philosophy is revealed in Socrates' activity of examination (...) and his refusal to deny his ignorance about knowledge. (shrink)

The article surveys the interpretation of Dewey in Italian new-enlightenment and in particular the contributions of Aldo Visalberghi and Antonio Santucci. Visalberghi develops a number of Deweyan insights on the connexions between the methodology of the sciences and the process for the justifications of evaluations. Santucci shows the analogies between Dewey’s pragmatism and Hume’s sceptical empiricism. Both thinkers enrich the attempt by 20th century Italian philosophy of a recover of the Enlightenment’s heritage with the help of Dewey’s ideas.

Norms conferring public or private powers, i.e., the competence to issue other norms, play a very important rôle in law. But there is no agreement among legal philosophers about the nature of such norms. There are two main groups of theories, those that regard them as a kind of norms of conduct (either commands or permissions) and those that regard them as non-reducible to other types of norms. I try to show that reductionist theories are not quite acceptable; neither the (...) command-variety (Kelsen, Alf Ross inOn Law and Justice), nor the permission-variety (von Wright, Kanger, Lindahl) provide a satisfactory account of competence norms.Among the authors who maintain that competence norms are different from (and hence not reducible to) norms of conduct are Hart, Ross inDirectives and Norms, and Searle. Ross and Searle distinguish between regulative and constitutive rules as two radically different kinds of rules and classify competence norms among constitutive rules. This distinction runs parallel to von Wright's distinction between rules that are prescriptions and determinative rules. While the first regulate actions (by commanding, prohibiting, or permitting them), determinative rules define certain concepts. To view competence norms as (partial) definitions of certain legal concepts (like those of legislator, judge, etc.) seems to open interesting perspectives and to shed light on at least one aspect of these elusive norms. Se interpreta la posición del filósofo, según la cual, si la lengua se aplica sin alteraciones, las palabras explican el contenido de las cosas de una manera correcta y adecuada. The article elaborates on Plato’s idea that words designate the nature of things they name if the language is used in the correct way.
